The Texas ESA

where are we at?
Gov. Abbot signed SB2 into law midday, Saturday, May 2, 2025. Now, the ball is in the Texas Comptroller Glenn Hegar’s hands to conduct “rulemaking” — putting meat on the bones, filling in the details, and finding partners (“Certified Educational Assistance Organizations”) to implement the program.
This is the most important time for Texas providers to get involved and follow the bill as it becomes a program. Join up with us to get regular updates throughout this adventure.
There’s simply too much we at First Day nor anybody can know about Texas’s ESA without Glenn and his team’s rulemaking process. All the content below is going to change before the program goes live.
what is it?
The Texas ESA is an education savings account (ESA) that empowers Texas families to access and direct their child’s education funding to cover private school, tutoring, and educational materials.
who is eligible?
Any public school-eligible student is qualified to apply (including Pre-K) who is a U.S. citizen or lawfully-admitted resident of Texas!
80% of scholarship funds will be reserved for students from low-income families (below 500% FPL) or students with special needs. The remaining 20% of scholarships will be distributed via a lottery of all other applicants.
when does it start?
The program will start in the 2026-2027 school year.
what is the amount?
$1 billion dollars are appropriated for the program for the first school year, families can receive:
- $2,000 per year for homeschooled students.
- Other students will receive 85% of the per-student public allotment or about $10,000 per year.
- Up to $30,000 per year for students with disabilities.
how can it be spent?
- Private school tuition & fees
- Textbooks, uniforms, & instructional materials
- Online educational courses or programs
- Breakfast or lunch provided by a private school
- Technology (up to 10% of the total scholarship award)
- Tutors, educational therapies, & transportation
- College or career training programs
- Standardized testing & assessments

who can be a provider?
Any education provider may apply to the comptroller for approval to participate in the program. Providers must be located in Texas or registered to do business in Texas.
